Welcome to A California Fishing App (the “Site”). By accessing or using the Site, you agree to these Terms of Service (“Terms”). If you do not agree, please do not use the Site.
1. About the Site
A California Fishing App is an informational tool for California recreational anglers. We summarize publicly available fishing regulations, species information, pier notes, and maps (including marine protected area outlines).
We do not:
- Act as the California Department of Fish and Wildlife (CDFW)
- Issue licenses, tags, or official legal interpretations
- Provide professional legal, navigational, or safety advice
- Guarantee that any regulation, map, or species note is current
Official rules are published by CDFW and other agencies. Always verify current regulations, closures, and license requirements before you fish.
2. Informational use only
Content on the Site — including regulation summaries, “no-catch” lists, special-water notes, pier articles, catch-log tools, and maps — is for general information. It is not a substitute for the official Freshwater or Ocean Sport Fishing guides, Title 14 of the California Code of Regulations, or posted signs in the field.
Maps, MPA polygons, OpenSeaMap layers, and coordinates are not for navigation and are not legal boundary surveys.
3. Accounts and catch logs
If you create an account, you are responsible for your credentials and for content you submit (including catch entries, photos, and saved spots). Catch logs are a private journal unless we state otherwise. Do not upload content you do not have the right to share.
You may not:
- Submit false or misleading information
- Interfere with the Site or attempt unauthorized access
- Upload malware or abuse the service
- Use the Site in violation of any law, including fishing laws
We may suspend or delete accounts that violate these Terms.
4. Intellectual property
The Site’s design, software, and original writing are owned by us or our licensors. Regulation text, maps, and third-party data remain subject to their original owners’ rights (including CDFW, OpenStreetMap, OpenSeaMap, and map-tile providers). You may not copy or redistribute our software or branding without permission.
5. Third-party services
The Site may load maps, fonts, images, or other services from third parties (for example map tiles, image hosting, and sign-in). Those services have their own terms. Optional analytics load only if you accept them in our cookie notice.
6. Disclaimers and limitation of liability
The Site is provided “as is” and “as available.” We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or for citations, closures, injury, or loss arising from use of the Site or reliance on its content.
7. Indemnification
You agree to indemnify and hold us harmless from claims, damages, and expenses (including reasonable attorneys’ fees) arising from your use of the Site, your submissions, or your violation of these Terms.
8. Modifications
We may change the Site or these Terms at any time. Continued use after changes are posted means you accept the updated Terms.
9. Governing law
These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules.
10. Disputes
You agree to try to resolve disputes informally first by contacting us at contact@acaliforniafishingapp.org. If we cannot resolve a dispute, exclusive venue is the state or federal courts located in California, except where applicable law requires otherwise.
